CIPPIC has been granted leave to intervene in the Federal Court of Appeal case Blacklock’s Reporter v. Attorney General of Canada (Docket: A-267-24). This case addresses the balance between copyright enforcement and user rights. CIPPIC's intervention will focus on the interplay between fair dealing and the anti-circumvention provisions of the Copyright Act.
CIPPIC also intervened in the underlying Federal Court proceedings, where it argued for an interpretation of the Copyright Act that maintains fairness between copyright owners and the public. The Court’s decision raised important questions about subscription access, password-sharing, and the application of technological protection measures (TPMs). CIPPIC will again argue for an interpretation of the Act’s TPM provisions that respects lawful and non-infringing uses of copyrighted works.
CIPPIC's intervention will help ensure the Court considers arguments that defend a balanced and principled approach to copyright enforcement.
